• Custom Orders: Once placed, custom orders are non-refundable after 24 hours.

• Production Times: Vary by product; timelines may extend during peak seasons.

• Shipping: Rates and estimated times are provided at checkout.

• Electrical Use: Most signs are rated for indoor use. Outdoor conversion options are available.

• Color Customization: LED colors and visual options are selectable where stated.

• Fog Machine Compatibility: Some signs are rigged for use with fog machines; fog machine not included.

3. Right to Modify Offering

Nightmare Foundry reserves the right to:

• Modify or discontinue any product or feature at any time without notice.

• Adjust pricing, availability, and customization offerings as necessary to reflect material costs, time, or seasonal changes.

We are committed to transparency and aim to communicate updates clearly and promptly.

4. Warranties & Product Responsibility

Our products are handcrafted and tested before shipment. We warrant that our signs will function as described upon arrival when used under recommended conditions.

• If an item is damaged or non-functional, contact us within 7 days of delivery with video/photo documentation.

• We will attempt to repair, replace, or, if deemed irreparable, refund the item.

We are not responsible for misuse, improper installation, or alterations made after delivery.

5. Product Disclaimer: Handmade Nature & Component Support

All Nightmare Foundry products are handcrafted, which means each item may feature unique visual differences, such as slight variation in paintwork, texture, or lighting dynamics. This individuality is part of the character of each piece and not considered a defect.

While most elements are manufactured in-house, certain components—such as LED strips, fog machine adapters, and power supplies—may be sourced from reputable third-party suppliers. These elements are included to enhance functionality but are not guaranteed by Nightmare Foundry beyond their standard use life.

That said, we stand behind our work. If a non-handmade component fails and your sign was purchased within two years, we will make every reasonable effort to:

• Diagnose the issue

• Repair or replace the component

• Shipping costs may apply.

This offer does not cover misuse, electrical modification, outdoor exposure beyond rated limits, or physical damage caused after delivery.

6. Ownership of Intellectual Property

All content, including:

• Product designs

• Photographs

• Videos

• Descriptions

• Logos and branding

…is the sole property of Nightmare Foundry and is protected by copyright, trademark, and intellectual property laws. Unauthorized reproduction or use of our content is prohibited.

7. Right to Suspend or Cancel Member Accounts

While we currently do not require accounts for purchases, if account functionality is added in the future, we reserve the right to suspend or terminate any user account that violates these Terms, attempts fraud, or abuses our systems, products, or staff.

8. Indemnification

By using this website, you agree to indemnify and hold harmless Nightmare Foundry and its owners from any claims, damages, liabilities, and expenses (including legal fees) that arise from your misuse of our website or violation of these Terms.
